If you're expecting Microsoft to come out and say "Yeah, go ahead and build custom ROMs," you're waiting for Godot. No company in their position would ever say that, because it would introduce vast loads of liability, authorization, and intellectual property issues.
As it stands, though, they have absolutely no reason to care about custom ROM images unless the carriers or another partner is complaining, since it's not like users can build their own device and install Windows Mobile on it. One way or another, Microsoft gets their money for each device sold. For that matter, XDA-Devs has a long history of taking down material if Microsoft complains--if they wanted to supress the unofficial WM6 ROM discussion there, all it would take is an email.
