Most websites hoping to keep things nice and legal regarding their distribution of roms always include a disclaimer saying (in so many words):

You may download a game ROM ONLY if you can do so legally. This means you must own the actual cartridge (or other media the ROM was distributed on) of the ROM you are downloading. This includes the EXACT ROM version and ROM revision that matches your original arcade machine hardware.Under the copyright laws of the U.S., you are entitled to own a backup of any software you have paid for. Since ROMS cannot be backed up without expensive machines that not everyone has access to, the ROM images here are provided to the public as a service. Most countries have similar laws but it is your responsibility to know the laws of the country you reside in.

An article I read recently stated that "you can legally download a Rom without owning the cartridge if you delete the file within 24 hours". How true this is, I don't know. In a reply to the article, one person refuted this statement vigorously :crooked:
