Interesting...so perhaps it is not breaking the "letter" of the DMCA but likely breaking the "spirit."

I imagine this technical "loophole" is one reason why all of the big corporate content providers are trying to force the tech industry to adopt hardware specs that would lock things up at both the hardware and the software level.
