The word "defective" comes to mind for the DELL version of WM 5.0

I Finally got past being upset and realized that things are not going to change with DELL. So, while I'm waiting (and waiting) for the DELL fix, I've decided to do the slow process of asking for a refund. BUT, using a very methodical plan. I saw a very good post on the DELL forum and I did the following reply: (At this point, I'm more curious to see how this will all pan out with DELL by going this route)

Of course, Aximsite members know all of these issues too.

Having owned DELL products for years, and my company has a business contract with them, I am very familiar with their history and the current state of affairs with their (lack of) support.

I've sent DELL an e-mail about their reprehensible release of "defective" software. WM 5.0 works on other non-DELL PDAs - it is not a MS issue. I expect to get a reply saying that I'm past my 21 days. I will then take that reply and snail mail the DELL legal department asking for a refund based on DELL knowingly shipping a defective product. And clearly we all know it is defective. And since DELL only provides a fix of "removing" the software, they know it is defective also. If I do not receive a refund at that point, I will forward their reply to both the Texas Attorney General and the state Better Business Bureau. Why would DELL want people to take this action. It seems that there is a much better way to do business. I believe we are all being fairly reasonable in expecting a non-defective product. Fortunately, I'm way past the "mad/angry" stage at this point and should be able to address the issue in a reasonable manner.

I have the disappearing CF card, random "no power up" (must do the soft reset) and the huge battery drain - even when the PDA is turned off.

No, I am under no illusion that DELL cares any more. And rarely do I use this word, but how stupid can a company be in this day and age? They have pretty good products and a lot of loyal customers. A little consideration or explanation would go a long way with us. This continued stone-walling and slow resolution to a known issue (and many other DELL problems) is going to eventually be their downfall. And it will be written up in the Harvard Business Review about how a once mighty company went out of business. Not any time soon, but the writting is on the wall.

Just my sharing of the venting process.
