Certainly they do purchase the Axim from HTC and it's quite believable that they have no direct input into the ROM and other software (though I don't know for a fact that this is true) but regardless, Dell are the ones that are selling and marketing the Axim. With this sort of OEM agreement, Dell are responsible to the consumer to provide the updates etc. This contract most likely specifically excludes HTC from any obligation to offer any support whatsoever.
Dell are the ones that we should be directing our comments to.
