The point trying to be made here, is that Dell is at the mercy of HTC as to updates and ROM releases. If HTC is holding out on releasing a new update, Dell (and us) have to sit and wait. We can complain to Dell all we want, and they in turn can put pressure on HTC, however it's an indirect complaint every time we contact Dell.

Look, Dell was very happy to take my money for the WM5 upgrade. Now, how can Dell ethically take my money, then have someone turn around and say it isn't Dell's fault the upgrade doesn't work, and Dell isn't responsible. If this upgrade is written by someone else, does that absolve Dell from any responsibility? Of course not.
Maybe Dell cannot rewrite the upgrade, or offer a fix until one is given to them, but one thing they CAN DO - is offer a refund if the product does not work properly. Whoever wrote it, it clearly does not work as it should for many x50v owners - and Dell should acknowlege that fact and refund money to anyone who wants to return it. That does not require and act of HTC to accomplish. It is simply good customer relations. In some small way, I think Dell is hurting their reputation with some power computer users.
To keep the money and blame someone else for the defect - sorry, but that is something close to fraud.
