Why could they not be legally distributed in ebook format? Just because they are copyrighted doesn't mean they cannot be converted to ebook. With their recent increase in popularity, it wouldn't suprise me if someone came out with a legitimate copy to buy.

They can be legally distributed in any format only with the authorization of the copyright holder. They can be converted to e-book - that is fair use - the person who converts them may not give them or sell them to anyone else without permission. That's the law. Pretty much the same deal as music files.

Thanks! I wasn't sure if books were the same as music. One thing I find a little confusing. I own multiple copies of all the LOTR books, If I find a d/l somewhere for the ebooks, is it illegal to d/l it??
And does anyone know who the copyright holder is? Maybe if enough people request the ebooks, they will put them up for sale.
Downloading it is just a quick way of making your own copy... ;)
Seriously though, I really don't understand the big deal over this to be honest... no one is making or losing any money by me downloading one of these copies ... I own paper copies of both books but I thought it would be nice to be able to have them with me at all times incase I feel the need to visit Middle Earth when I have some down time... If or when legal copies do come out in electronic format I will be one of the first in line to purchase them... I have no problems with paying for an electronic copy but until that time comes I don't have a problem reading one of the illegal copies. The legal copy will be in much better shape than the ones I have anyway...

As far as I know, it is legal to make copies yourself - that's fair use - but not to distribute copies that you have made. If you are downloading it then somebody else is doing something wrong.

It is the Tolkien estate/children, prinicipally his son, Christopher Tolkien. He has been very tight with permissions to do anything with the text - very controlling.
I got the combined LOTR trilogy ebook right about the time the first movie came out from a large reputable PPC site. It was listed along-side other classic literature, all appearing to be public domain. I had no idea it was no longer being distributed freely. Kind-of makes me wish I'd looked harder for The Hobbit back then...
