I know nothing about the version you found but two people were arrested in the UK for trying to peddle actual advance copies which they did have on their person.
If an advance hard copy is out there then an unauthorized electronic copy could certainly have been produced.
The version of the book you found is a fake. It's actually written by a fan with too much on his/her hands. I had a look on irc(undernet - #bookz) just to confirm. It's not out yet, how would someone scan a book that's not out yet.
About ethics, personaly I've read plenty of e-books that I don't own. Unfortunatly, I don't have access to many English books here in Israel. I mean sure most of the popular books are available but there are plenty of great books that I have no way of getting my hands on. If you live in the US or England you can buy pretty much any book ever made through Amazon, in that case you have no exuse downloading books you do not own. On the other hand if you do own them I think it's perfectly exeptable to download electoric versions of the books. I mean think of it this way, you could have scanned it yourself, you're only downloading it to save time.
I agree with you generally, if they wanted your business, they would make it available to you... But you could still order them and pay 35x it's value in shipping costs...
As for how it could be available, before it is released, well all it takes is an insider. The story would have been edited and approved and sent to printing, and then a certain number of advane copies are usually available to the Author and such... It only takes one person to take it home for "review" while their 12 year old converts and posts it to usenet or Kazaa.

When this thread came out, I started looking and found 4 different "files" calling itself the Half blood prince...
They were all the same 'story' or portion thereof, AND it was fanfiction, not the real story.

It was the writting style and it really did only take a sentence or two and I said wait a minute this just does not READ right. Went to the end and there was a disclaimer.
I don't know if we have the same fake copy, but in mine in the first page we see Dudley and Harry having 'soda', which is an American way to refer to fizzy drinks. And considering that Rowling is British, I believe that the copy must be fake. Moreover, in the first couple of pages we learn several off the wall news about Harry and his family some of which are as follows:
Voldemort is Harry's (Dudley's too, of course) Grandfather! (A little too Star Warsy, isn't it?), Petunia is also a witch, and Dudley is a wizard, too. Sirius is still alive, and Harry is Cho's boyfriend. And Harry and Dudley are kind of 'buddies'

I read books that I do not "own" on my PDA all the time.. and one can argue that I'm taking money from the publishers. But if I didn't read them on my PDA, I'd get them from the library and they would STILL get no money from me. It's a circular argument.
At the end of the day, though, I prefer my books in paper. I can read e-books up to a certain point, and I prefer them as far as "instructional" books go, but I like my good ol' paper. And when I want a paper book, I simply go to the library. It's a free alternative.

ForkyFork your argument is the one that I use as it makes the most sense to me. However I do believe in support and artist and as such am more inclined to pay for their work. But my fuzzy logic does kick in and if I have bought a book in the past and have it as hard copy or have had it then I see no issue with picking up an electronic version "free" having paid for it to my way of thinking by past actions. As do you I go to the local Library frequently to pick up a new read. I like to support baen.com becasue I think that the price structure is fair and the service I receive makes it worth while to pay the $15 US bucks for multiple books. If more of the electronic sites were trying to supply the e-books at such a reasonable rate they would see their sales pick up...or at least I think they would. Time will tell.
I recently suggested to Raymond Feist that he have his publisher release a free ebook of Magician and see what happened to sales. He didn't really go for it, but I guess his reasons were understandable. I really think more dead-trees would get sold if other publishers would look at what Jim Baen is doing and see what it's doing for his writers. I was googling for ebooks the other day and I stumbled on a quote where Mercedes Lackey said that her books from other publishers increased in sales as a result of her inclusion in the free library. Baen has got the right attitude when it comes to e-books, in my opinion. Some of these authors with Tor, Spectra, DelRey, etc should start making inquiries about that, but I doubt they ever will.
