Anyone else having problems with their Axim resetting while playing PocketNESter?

I have noticed that my Axim will sometimes perform a reset when I press the "Home" button in the midst of playing a NES rom. The screen will black out forcing me to have to turn it back on via the power button. I am then prompted with "Push x button to clear all data, Press y button to cancel". No matter what I press, my data is lost.

Is this happening (or has happened) to anyone else? I sent Dell Tech Support an e-mail regarding this in the meantime. Just hoping that I can get a replacement if the hardware is faulty (Its about 9 months old now).
