you see that's the problem with telephone calls... it's hard to verify them afterwards (unless you record all of your conversations and tell the person that you are recording them)...
It could be a simple case of misunderstanding, in the first 3(?) weeks you'd get a new one, or maybe it's a misunderstanding between 'new' and 'brand new', or maybe the person on the end of the phone screwed up and made a mistake.
It's a lot harder to argue with what's written in black and white. So if this really is a deal breaker for you then you should resolve it with dell during whatever 'cooling off' period you have.
