Dumbest Lawsuit.... Ever.

http://edition.cnn.com/2006/LAW/02/0....ap/index.html

Quote:
SAN FRANCISCO, California (AP) -- A Louisiana man claims in a lawsuit that Apple's iPod music player can cause hearing loss in people who use it.
Quote:
The iPod players are "inherently defective in design and are not sufficiently adorned with adequate warnings regarding the likelihood of hearing loss," according to the complaint, filed Tuesday in U.S. District Court in San Jose, California, on behalf of John Kiel Patterson, of Louisiana.
What a disgrace. Not because this guy is suing Apple specifically, but because it hasn't been thrown out already.

John Patterson - if you're reading this, please be aware of some of these other dangers.

Stairs - if you fall down then you might hurt yourself. Maybe they need labels.
Knives - don't try to swallow a sharp knife. There is a risk of injury.
Cars - if you step in front of them and they're moving at high speed, you might get hurt. I know, they're not labelled either. Crazy eh?
Petroleum - You'd think that for something that is so freely available they'd make you sign a disclaimer each time you fill up your car that you won't drink it. I'd hate to see how many people have confused it with water.
Cans - Why don't they have directions? You could choke swallowing a can of coke. The opening instructions leave something to be desired.
Cell Phones - Whatever you do, don't stir fry these without removing the battery. The heat could cause them to explode.
Elevators - Watch your head. If you step into an elevator but leave your head sticking out there is the chance of injury from the doors.

I agree ... this is an absolute waste of time for the legal system. However it looks like he's got a case, because some other idiot (oh never mind... it was the French Laws) tried this in France and they ended up forcing a code change on the iPod limiting it to a maximum of 100db...

Might need to clean out your ear with cue-tips, but that'd be mighty hard when you're not supposed to stick anything smaller than your elbow (as I heard many years ago..) in your ear.

oh and also, HE HAS NOT HAD ANY HEARING PROBLEMS DUE TO THE MASSIVE AMOUNTS OF SOUND WAVES THE IPOD IS CAPABLE OF PUTTING OUT. none, no hearing problems, he just turned it up and said hey I can sue apple.

The easiest more simple fix, too loud turn the volume down.

Maybe we should label stupid people.
WARNING: May do something stupid. Stand clear.
Just a little tattoo on the forehead would do.

How could you disrespect a president who won reelection on a last-ditch "hate gays" platform?

p.s. I look around every day, in awe of just how stupid "average" is.

That's part of the reason that I've pretty much abandoned network TV... Almost all TV shows are targeted at imbeciles (IMHO).

Personal responsibility started going out of style when the Great (Tongue firmly in Cheek) Lyndon Johnson started the great welfare state and rewarded people for being lazy, shiftless and having massive reproductive capabilities. It has grown steadily worse with each generation. I did the taxes this week for my idiot niece and her “live in boy friend” and their claimed earned income was less than $8,000 Dollars, they received a refund of $3,029 dollars be cause of certain rules that apply to shiftless lazy people that have kids but are to useless to support them, my refund after paying in a very large amount of my income into the tax system, $50.
I sometimes think we need to prune the gene pool and let the stupid, lazy jackasses drown in their own self pity. I personally am tired of the whole “poor is me” attitude of so many idiots. But you know once they have kids they have you by the ……….ears.
