I think its safe to say that every communication portal is traceable its just that authorities have been limited as to what they can and cannot do. Well that used to be the case until all the new lesigslations were brought in to combat terrorism. Now they are allowed to use invasive technology to monitor everything we do.

OK, I know you are asking about legal issues, but what about moral issues? Wouldn't it be proper to tell your friend's ex-girfriend that maybe she should change her password to that email account. Now I know your gonna say that you don't want to break your friends trust, but heh, if he is already reading someone else's email can HE be trusted. Who knows, maybe this guy is going through your personal stuff already.
