Update: Just talked with my insurance company, I guess the other party of the accident filed a claim with them. After taking our two statements my insurance thinks it is her fault :). Although I guess she didn't take that real well and got nasty on the phone with them.

Just goes to show you that if you make me hit you it still is your fault!

It's good advice, but in some states (if not all) the police often will not respond if the damage is minor and there are no injuries. In Mayrlayd they're not required to. They may show up if an officer is available, but they won't necessarily file a report.

Most insurance companies have those What do do in case of an accident brochures. Always carry one in the glove box and use it when needed. Also, take pictures of the scene, the cars, etc. And get witness identification.

You may not need it all, but it is too late unless you get it at the time.

I've had friends get into an accident and wait to get the police report until later, and since the cop was never at the sceen the report was so wishy-washy the insurance companies split fault.
