I wonder where Dell stands on this legally as it appears that microsoft are the ones that set the 23rd May 2003 date

We may not have any 30day return from Dell here in the UK but they have to abide buy the distance selling laws which I think gives you 28 days to return the goods.

I too think it's a little much charging £30 ($50 US) for the upgrade. I don't think I'll be bothering unless it fixes the problem with the SD cards and then I'll just be having a refund or replacement.

Well we didn't sell supplies (i.e. oil, weapons, ammunition) to Hitler or the Japanese and that is precisely WHY they attacked pearl harbor and pulled us the rest of the way in. You might be still paying us for the supplies, when do you intend to cover all of the blood spilt? Who paid for all of the supplies that are at the bottom og the atlantic? Please tell me when exactly the UK signed the Kyoto protocol. No has signed it because it is not a good deal for anyone but China and Mexico. Having a Government that says it will sign it if the US does, knowing full well that the US would never re-enter the 17th century (well it would really be the first time now wouldn't it) willingly is a farce and you know it!

As for the IRA funding...it happened primarily in New England by IRISH americans and I believe that it is humiliating to all americans that it was allowed to go on as long as it did. I cringed when Pres, Bush made comments regarding "Counties that support Terrorism" after 911, and was quick to point out "our hypocrisy" at local tavern discussions. And I have always, and still do support Pres. Bush! I do not believe the UK was entirely innocent of any wrong doing in Ireland either..do you?

As for foul language, I believe there was something foul about your comments as well. however, to your credit, it was explitive free. Kudos for you!

I agree with you that it is not fair that you are treated differently. One would think that a global co. like dell would set global standards, prices and policies for doing business. Lead the way on your fight and I will be here to support you.

Do you know what's funny?

4.5 years ago I used to work for Dell UK - in their Preferred Accounts Division - this was support for large corporate accounts. Because most large accounts had brought same-day or next business day service, we had to be on the ball. Customer had a problem - we tried to fix it over the phone; not a PC-scripting system in sight! And the web was a joke...

Now look at Dell's UK support. Every time I ring up and ask about Windows Mobile 2003 upgrade I get a different answer. Guess Dell are now the joke and the web (i.e. Aximsite!) is the source of all Axim info...:p

Despite how you feel about the way Dell is handling the Upgrade for UK, it's probably not the brightest thing to go announcing that you're all set to get the update for free and then post it for free. It also makes the site look bad!

Distance selling regulations - cancellation periods
The regulations give consumers an unconditional right to cancel an order. This is to allow the consumer the opportunity to examine the goods or consider the nature of a service.

goods – seven working days from the day after that on which the goods are received by the consumer;

yeah thats dam short :/

Had my axim last thusday, will be seven days tomorrow
althought i dont think i will return my axim, i'm going to keep onto dell until I get the upgrade free whatever it takes :D

I wish everyone would stop belly-aching about this AND quit the mudslinging and racsit i.e. anti-american/english remarks - its narrowminded and uncalled for here.

Bottom line. The computer industry is CONSTANTLY upgrading its hardware and software. If you MUST have the latest thing then PAY for it. Most of you knew - via this site or the specialist media that the new OS was imminent so why didn't you wait? Oh and a word about 'new' software (and hardware to a degree) invariably are full of bugs and rarely work properly at first so IF you do get it be prepared for future patches and fixes.

Me ... I'll wait a while and see how it pans out. I'm satisfied with my Axim as is. :)

I don't necessarily agree with evertyone's historical assessment or information. I for one grew up in Singapore. I also understand why the Japanese went to war in the first place. And by the way, my father and grandfather were both incarcerated at the notorious Changi concentration camp on the island of Singapore. As a US citizen, I must say that making snide political remarks when your complaint is really with Dell UK, is just not on, rather bad show what!
