I have no idea of the legality of the issue but there are a few items that seem crazy.
First I think credit card purchases will not allow a charge dispute after 30 days. You may even try since each card company may have different policies. It would not hurt. Being that Dell is an online retailer, I would say 90% + are made via credit card vs accounts such as a business (billing accounts) for normal Axim users.
Dell has sold a defective item. Regardless of the issue of the 30 return window, the item is defective and Dell has acknowledged this.
Do they expect consumers, not just us in AXIMSITE, to sit idly by while the 30 days (maybe 60 days for the 1st purchasers) to wait for a patch.
I forsee some type of class action lawsuit for refunds since 1st of all, they sold defective items and later pulled the item. There was no recall for the defective items already out (purchased). They found the item 'defective' enough that performance was hampered to a point for Dell to decide to cease sales.
30-60 days of warranty is gone, lost, since the unit does no perform as expected and designed. There is no user compensation for the defective units except some comforting 'the patch is in the works' promise. No extended warranty, partial refund etc. Dell just keeps the money.
