It isn't Dell's fault Microsoft did not hold up their end of the bargain again, as usual. 90% of the beta testers don't even get rewards from MS, so there's your quality! MS wants it free, and expects you to pay for it.


When companies stopped rewarding beta testers with the product or equal (or better rewards), their quality of their products has plummeted. Been there, seen it happen, tried to tell them, oh well....


Microsoft can change software/drivers without notice. Seen it happen and ruin businesses cause of it. Dell provided the hardware, Microsoft is to blame for yet another buggy OS. No competition, so deal with it or buy a Mac. :violin:

Naah. This is the way companies operate today. The one I work for does exactly the same thing. They promise stuff they don't have, force the developers into sweat-shop mode for awhile, release a not ready product then patch it for awhile until the bugs are fixed. We've got enough lawsuits ruining our economy as it is ... go play with the kids or something.

not me... my wife is in law school and has a friend who worked in m$'s legal department over the summer. they have more lawyers than L.A. has "aspiring actors."

but yeah, it's a shame that deadlines matter more to corporations these days than releasing a quality product. i actually credit dell for not releasing the WM5 upgrade cd before the bugs are worked out. if anyone hasn't heard yet, dell has stated that it still has too many install issues to be distributed, so they won't be shipping until it's ready. i know it sucks, and they shouldn't have strung us along like this, but at least they're working on it.

ive about had it myself. How difficult is it to give us a product that works. Id rather wait a little longer and get it in working order. I cant stand dell or ms right now.

The only way they listen is if you don't buy there product ...
you get suckered once word gets around and then they either improve or die..
Sometimes the corporations forget this but in the end if you don't like it stop buying it till they get it right!
Right now hollywood is trying to tell the consumers how they will need to jump thru hoops to watch hi def dvd's when they come out...
If no on buys them they will learn...but they seem to forget this when they grow too large...

Stop with the class action junk... It's just going to make some lawyers even more rich... please... if you hate wm2005 that bad go to dell.com and d/l the roll back to WM2003SE and stop the whining... if you have an x50v.

if you have an x51v then return it and stop this silliness!

Within the past year I have adopted what I call the 7 day rule. The 7 day rule staes that if a piece of hardware or software does not function as advertised within a 7 day period it gets returned. I will not be one of those who check the boards everyday to see if the new drivers have come out to enable me to use something I've bought a few months ago.

The voice of the consumer is a lot more powerful than a court case. If you don't like WM2005 or the device that it came on, return it, get your money back and move on! If sales go in the toilet because of a poor Microsoft product then the market will take care of itself.

You didn't address any specific issues here. You just created a thread and whined about nebulous, unspecified problems that apparently don't even exist yet.

You call WM5 "crap". Why, specifically, does it warrant this name-calling?

You say WM5 is not ready for public consumption. Care to elaborate with a few demonstrable facts so we can see what your problem is?

You say we'll "no doubt" be inundated with fixes and patches, though the same is true for every OS on every platform out there. Some just have different names for their patches so they sound cooler. You may as well complain about the tediousness of breathing.

You claim that Dell and Microsoft knew that WM5 would not run properly. What proof do you have that it's not running properly, and what proof do you have that these companies know this?

You mention the companies using the attraction of a new OS to convince people to upgrade or purchase new devices. This is called Capitalism. Deal with it.

You call the platform 'worthless'. I see plenty of worth as do many others. Why can't you?

If you are indeed an actual attorney, you'd think you'd know more about CHECKING YOUR FACTS and BACKING THEM UP before you make an accusation.

Were you to take your excuse for a case to a court and challenge Microsoft's lawyers face-to-face, the *things* they'd do to you would have to be censored before the details could be released to the public, and you'd walk funny for a few weeks.

If this were something you seriously wanted to pursue, you'd need to find and document very specific instances of crippling problems with the OS. You'd need piles and piles of details and documentation illustrating the existence of these problems, proving that Microsoft was aware of the problems, and that Microsoft deliberately chose to release the OS without any intention of addressing them.

In short, you need a hell of a lot more than 'It sucks and I not only want my $30 back, but I want Microsoft to suffer because they made me angry!"

Having read this thread, I am sure that Tlav is one of those millions of out-of-work ambulance-chasin lawyers who go around finding old people to try and build class-action suits against companies that give them money just to shut them up. Why don't you get one of the TV commercials and see if you can find any old people how think they have asbestos contamination so you can get a class action suit going. I am sure you are just looking for a bunch of unhappy people to get behind anything so that you can lead the way to an out-of-court settlement. Go wait at a corner for an accident.

Tlav, how could you possibly buy a PDA and not know it had a new OS on it? Every other buyer knew it except you. Maybe we should petition Dell to have a minimum requirement for buying their products, such as "have you even read anything about the product?". It would probably save companies a lot of money in lawsuites if they prevented morons from buying their products.

Tlav, you sound like the lawyer that got that old woman who spilled coffee on her lap from McDonalds. Of course in the lawyer world, he is probably a hero, but to the rest of us who have to pay more for coffee from McDonalds, that lawyer is a few levels below pond scum.

WM5 is a new operating system. There are problems with it, as there are for ANY computer application ever made. Your lawsuit idea just shows me how little lawyers actually know.

Enough of the lawyer jokes already; we aren't all bad. :hide:

I would imagine that tlav's post was meant as a tongue-in-cheek comment, and not a serious proposal to find a resolution through the judicial system for any problems WM5 may or may not have. If that is indeed the case (and I fervently hope so), then I'd suggest to those members so utterly dismissive of the thread, that perhaps they take it in the spirit in which it was intended. :)

Of course, all the above is only interpretation and in no way does it render me liable should you choose to rely on....oh, er, carry on. Forgot I'd finished work for the day.
