Generally speaking, you don;t need or want to have to get it - it's more a case of getting a phone or PDA that comes with WM5. There are updates / upgrades to WM5 for some specific device models, like the X50V - but a huge number of people have had major problems when updating a device that did not run WM5 out of the box.
I would suggest that always looking for a device that runs WM5 out of the box is your better bet ... Quote:

PDAs have the operating system installed as firmware. Now and again a firmware update will be released, updating the ROM, but in the case of WM5 you are best off getting a PDA already flashed with WM5.
