Dell have promised to replace my Axim

Dell have promised today to swap my Axim over for a brand-new one with the A05 Rom - I phoned them up on their tech support number and kept whingeing like mad, until the lady gave in to my demands.

She started saying that the a05 patch would be availible in a week - which is the same as I was told the last two times I phoned - both a week apart from each other - I told her this, so she started going on that the A05 rom has problems with Bluetooth - I then had to point out that the Axim doesn't have built in bluetooth!, then she seemed to be a bit stuck, and said the update was still not availible at all, so I asked how new Axims were being sold WITH this A05 ROM.

She then seemed a bit lost, as I was stating things she seemed to not know (:) thanks Aximsite) so I then said that according to the UK Sale of Goods act - an item sold has to "be fit for the purpose intended" and "as described" and "of satifactory quality" and as the Axim was not fit for the purpose (- it keeps dying) and was not "as decribed" (- it does not run fast - as per some dell sales paperwork) and is not satisfactory - to me, then I wanted Dell UK to swap my unit out for a Brand New unit with the A05 ROM.

I am expecting my replacement unit on a swap over replacement arrangment to arrive tomorrow - wish me luck, and any pointers to things I need to check it IS a NEW unit and not reconditioned?

well they replaced it, and the new one has A05 ROM :)
