I've had my Axim for about 3 months. It never seemed to work right, buttons would not work half the time, and the screen had lots of dead spots. The problems only got worse. Dell agreed to send me a replacement which should be here this week. Is there any chance that I will get the new os with it?

I doubt since I believe they change them with refurbished systems.

Mine was replaced with a brand new unit. Does happen but probably unlikely.

As long as it works right I don't care what it comes with. I was just thinking about buying the upgrade to 2003, not sure if it's worth it though..
