That's where you are wrong, when you buy a OS upgrade you are buying a new license of the OS and you can choose the language of the OS when buying.
For example I have a PC with W2K french OS, I can buy XP english to upgrade my PC there's no violation here. Also I bought an Axim with WM2002 FR in the past and when I wanted to upgrade I bought WM2003 EN from Dell nothing illegal as well. And the upgrade went smoothly.

I think so too. A violation would be when you
change the
language with the same OS (eg English WM2003 -> French WM2003).
What I should have said is that, the *update* program (eg
ROM A01 -> A02) will check the device
language. But because, I'm guessing, that they're just re-using the code from the *update* program, even the *upgrade* program will check the
language, making an upgrade as in tobeast's case not work.
