Ok, but that didn't answer my question. I'm out of warranty and not sure how to engage a 'live chat' session. When I enter the required service tag their website notes that I'm out of warranty and won't allow me to do a live chat. It redirects me to send a support email or call them. Is there a way around this?
If you are out of warranty, you will have a tough time getting Dell to replace it for you. So I will have to say that you probably will not be able to get Dell to replace it. I would just stick with your x50 running WM2003SE. Its probably more stable than the x51v running WM5.
please read my previous posts from page 27 &28. My warranty was expired on april 2006. However, I still got replacement . I basically chatted with customer care because you can't pass the chat login if you enter the service tag which has expired warranty. So, after you have chance to chat with any agents, you can request for a replacement of your axim.
I just got the 51V from DELL US. I don't know if i was lucky or not, but YES, you still can get the replacementi f your warranty was expired. . It worked for DELL US, but for DELL UK, I don't know

Supv basically said if you attempted the upgrade and experienced the known problems, they can replace with x51v. The key is that you must have used the upgrade CD to see that your x50v has the issues everyone is complaining about -and - you must say that you can't use wm2003 (add reason here) -and- you bought with the understanding that it was compatable with new OS.
My problem is they removed the CD from sale before I could buy it. Unfortunately I admitted this. They seemed to want me to say I upgraded, but I couldnt bring myself to lie. He even implied that I can get it from a third party and try it to qualify for replacement. It was almost like he was following a checklist and hoping I answered yes to all questions. I may be out of luck this time because I did not buy the CD when i had the chance.
[Edit Note (9-24-06) - I eventually tried again after buying WM5 upgrade disk and legitimately attempting the upgrade. After several chats, they finally agreed to exchange. I will post details later after I have completed the exchange. This was an out-of-warranty exchange with wm5 purchased not from Dell.]

Sounds like you were very reasonable with them and got a reasonable answer. I applaud you on your ethics. way to go.
I was first upset with Dell for not coming up with an working Upgrade for my Axim X50v and WM5. But thanks for this thread I was able to upgrade my x50v to a x51v.
Now I am very impressed with Dell.

I agree that nonpaq took the higher road and acted ethically. Where I have difficulty is with Dell's so called ethics releasing WM5 for the X50v. For me it came down to bending the truth to get an upgrade as I could not tolerate Dell's decision to release it when riddled with so many problems.
If "ethical" is defined as the decision between right and wrong, IMHO Dell was unethical releasing WM5. While 2 wrongs don't make a right, I am comfortable with the efforts and truth bending I had to do to get an upgrade from X50v to 50v.

I got the bare X51v step up. So yesterday I got on the Dell tec chat, and there sending the the companion disk for the X51v ...No problem getting it. Just some FYI.

We must have spoken to the same person :) the Dell Supervisor I spoke to said exactly the same thing.
The earphone jack on my x50v just stopped working - no sound out even though the speaker is ok. Chatted with a representative who agreed the machine had to be replaced (I'm within warranty). I asked for it to be replaced with a x51v due to WM5 difficulties and he didn't even hesitate in agreeing. He wouldn't budge on the refurbished unit but he did agree to ship it with the companion CD. I'm not sure that they even have x50v's left as replacement units anymore. In any case thanks to Patrick and everyone else who posted their experiences here. Without this thread it would never have occured to me to ask for the upgrade.
I think we have a right as consumers to hold Dell (and any other merchant for that matter) accountable for the goods and services they sell. I was not able to get a replacement for my x50v (I still love it though :) ) but I did get a refund of the $40 I spent on upgrade CD. I would not have followed through on my complaint with Dell without the info. posted on aximsite. Thanks again guys!

I don't get it.... why does Dell Canada still offer the WM5 upgrade CD? Under what possible circumstances would Dell remove it from USA site but not Canada? Makes you wonder....
I also wonder if it's possible to get it shipped to USA if one buys it from Dell Canada. Any takers?

It's obvious.... WM5 is compatable on the x50v in Canada, and not in the United States. (or they don't care if their Canada customers upgrade, just to downgrade a few months later when the problems creep up.)

The checkout limits to Canada, and you most swear that you will not be exporting out of Canada.

only if you want the two games - toy gold and rad rally and the diagnostics. everything else is the same. Dell sent me one for free.
I finally decided to try and install the upgrade CD that I purchased in Oct. I did a hard reset and then downloaded AS 4.1 and tried to install the upgrade. I got an unable to continue message telling me that I had the updated ROM for my pocket pc. So I was unable to actually get WM5 onto my x50v to try it. (I purchased x50v in Jan 05 with 2 yr extended warranty)
I then went online to the Dell Technical Chat and had about an half hour wait before i was connected to a representative. I told the rep that I was having problems trying to install the upgrade. He apologized for the inconvenience and offered to send me a X51V. I then asked for the companion CD which he is sending. He said I should receive it within 3-5 business days.:)
