I would say, wait until WM6 comes out to buy a new device. Also buy refurbished; you will probably end up with one anyway.

When I can even get it to power on (and doing hard resets isn't often successful), it may freeze during the hard reset.

On the few occasions I thought it was working, it would normally freeze during a restore from an old backup.

Can't blame a WM5 upgrade, since I never bought that upgrade.
