im having trouble with the battery latch issue and dell offered me a new unit but i was wondering if they send a refurbished or new unit when they replace my unit.... has anyone had to do this?
Dell stopped production on the Axim a long time ago so I doubt that they have many new units available. Even when they were producing them, the rule was you'd only get a new unit as a replacement during the first month after purchase.
As for the battery latch issue, have you tried a piece of tape on the small peg that depresses the switch inside the door (I used masking tape which is thicker than scotch tape). This fixed the problem for many of us. Some people also used a drop of glue on the peg (allowing it to dry before putting the door back in place) to build up the height of the peg.

I teach electronics, and most of the time refurbished is BETTER than new...
Used to when you purchased a computer there was a 72 hour burn in to see if everything was going to work correctly. They no longer do that as it is cheaper to just replace the unit if there is a problem.
A solid state componet should never "wear" out as there is no moving parts. All you are doing is making a semi conductor conduct, by adding a postive charge to the gate lead. They go bad because of a mfg defect in the piece. Refurbished is usually just a long test time for the item, with the bad part changed out.
I've had a refurb x51v and it has been fine. I also buy refurb for my office computers since 1998. Only problems have been in the last two, and new parts were sent out the next day. The only downside is your warranty is not automatically extended and I don't know if you can pay to have it extended.
Personally I would prefer the refurb, to the masking tape.
I can personally vouch for the Dell refurb units. I have replaced over 200 PDA's thru Dell complete care. All are refurbs and I have had zero problems due to their refurb status. X5's, X50's, X51's, 'v' units.
Having said that... users still abuse their PDA's....cracked screens, bent pins, broken buttons. You name it, they do it. One drove over it w/ his car. Dell replaced that one based on that problem description. The c/s rep got a good chuckle out of that call.
